Extenuating Circumstances Policy

Overview

In general, cancellations and refunds for La Paloma reservations are governed by our  Cancellation Policy. In the rare circumstances that a large-scale event prevents or legally prohibits completion of a reservation, the Extenuating Circumstances Policy may apply where a reservation may be cancelled without consequences.
This Policy applies to reservations for both accommodations and experiences, and is applicable to reservations that are ongoing or that have a check-in on or after the effective date. The Extenuating Circumstances Policy is not an insurance policy.

What events are covered

This Policy uses the term “Event” to refer to the following situations that are unforeseen at the time of booking or during an active onsite reservation that prevent or legally prohibit completion of the reservation.

Declared emergencies and epidemics. Government-declared local or national emergencies, epidemics, pandemics, and public health emergencies. This does not include diseases that are endemic (for example the flu) or commonly associated with the area—for example, dengue fever. COVID-19 is not covered under this Extenuation Circumstances Policy.

Government induced Military actions and other hostilities. Evacuations due to: Acts of war, hostilities, invasions, civil war, terrorism, explosions, bombings, rebellions, riots, insurrection or civil disorder.

Natural disasters. Natural disasters, acts of God (wild animal/insect invasion), large-scale (more than 24 hour) outage of essential utilities, volcanic eruptions, tsunamis, and other severe and abnormal weather events. This does not include weather or natural conditions that are common enough to be foreseeable in that location—for example, hurricanes occurring during hurricane season (May-Oct). Hurricanes are covered only when they result in another event covered by this Policy that prevents completion of the reservation, such as a mandatory evacuation order or large-scale outage of essential utilities.

When a large-scale event occurs, we assess the situation to determine whether the Extenuation Circumstances Policy applies. If it does, we activate the Policy for the impacted area and timeframe where we anticipate that the Event will prevent or legally prohibit completion of reservations. Reservations outside of the defined area and timeframe may not be eligible.

What is not covered

We understand that other circumstances outside of your control may disrupt your plans. In any situations not listed above, your reservation remains subject to the Hotels Cancellation Policy.

Common Events not covered by Extenuating circumstances policy include:
- Events that impact a guest or their ability to travel, but not the hotel
- Unexpected injury or illness
- Government obligations like jury duty or court appearances
- Non-binding travel advisories or other government guidance that fall short of a travel ban or prohibition
- Cancellation or rescheduling of an event for which the reservation was made
- Transportation disruptions such as airline insolvency, transportation strikes, and road closures due to maintenance

Hotel not liable for guests behavior and/or accidents/incidents outside hotel property.
